When going into business, especially for the first time, you need the right advice as to the most appropriate legal structure – whether it be a company or a company as a corporate trustee; trusts – discretionary or unit trust; a partnership or even a joint venture.

Assaults

In WA, criminal law is codified as is in Queensland.  Other States use Common Law.  In WA, assaults are dealt with under Chapter XXX — Assault of the Criminal Code Act Compilation Act 1913. I can advise you in relation to assault charges, whether it be common assault; assault causing bodily harm; assault with intent or serious assault.

An assault is the act of inflicting physical harm or unwanted physical contact upon a person or, in some specific legal definitions, a threat or attempt to commit such an action. It is both a crime and a tort and, therefore, may result in criminal prosecution and/or civil liability.

Estate Planning

As an estate planning lawyer, I advise clients in the creation and implementation of plans that effectively express the client’s personal desires regarding the disposition and protection of assets while providing potential tax advantages and security for family and beneficiaries.

I help clients prepare their Last Wills whether simple or complex. Without a Will, State law determines who inherits your property. A Health Care Proxy, Living Will and Power of Attorney are all an important part of an estate plan and I work with my clients to put these documents in place.

Traffic Law

If you have been charged with a traffic offence such as drink driving; driving with a prohibited substance in your body; driving whilst under suspension or disqualified from driving, you may need to seek the advice of an experienced lawyer in respect of your rights and the consequences of any convictions.

It is important when preparing your defence to a traffic offence that you obtain comprehensive legal advice. You may also wish to seek advice in respect of how best to prepare for Court, should you wish to represent yourself in your legal matter.

Drug offences

The Misuse of Drugs Act 1981 is an Act to prevent the misuse of certain drugs and plants and to provide for matters incidental thereto or connected therewith.

The different types of drug offences pursuant to the Act range from simple possession of a prohibited drug, possessing a prohibited drug with intent to sell or supply, cultivating/growing a prohibited drug, conspiring to sell/supply a prohibited drug and trafficking quantities of prohibited drugs.

Property Law

Property law is the area of law that governs the various forms of ownership and tenancy in real property (land as distinct from personal or movable possessions) and in personal property, within the common law legal system. In the civil law system, there is a division between movable and immovable property.
